General Terms and Conditions of Sale

Dear Customer, these General Terms and Conditions of Sale (hereinafter referred to as the “Terms”) govern the offer and sale of products under the Morani s.r.l. brand (VAT No. 02088850983), with registered office at Via dei Ronchi 46, Polpenazze del Garda (BS), through the e-commerce portal www.frantoiomorani.it.
The relationship between the Seller and the Customer is based on maximum transparency and clarity, in full compliance with applicable regulations.

Acceptance of these Terms, which occurs during the purchase process on the website, constitutes a binding contract between the parties pursuant to Article 1341 of the Italian Civil Code. Morani s.r.l. reserves the right to update or amend the Terms at any time; new clauses shall become effective upon online publication.

 

USER REGISTRATION AND RESPONSIBILITY

To access sales services and make purchases, users must complete the registration process.

  • Accuracy of Information: The user declares, under their own responsibility, that the information provided (name, address, email, tax data) is true, accurate, and up to date. Morani s.r.l. shall not be held liable for shipping or invoicing errors resulting from incorrect data supplied by the Customer.
  • Account Management: The user is responsible for safeguarding their login credentials and agrees to promptly notify the Company of any changes to personal data or any unauthorized use of their account.
  • Privacy: By registering, the user confirms having read the Privacy Policy and consents to the processing of data necessary for order fulfillment.

 

PURCHASE PROCEDURE AND ORDER COMPLETION

  • Product Descriptions: Each product is accompanied by a technical data sheet describing its main features. Images are for illustrative purposes only; variations in color or packaging due to manufacturer updates do not constitute lack of conformity.
  • Order Confirmation: After submitting an order, the Customer will receive an automatic “Order Receipt Confirmation” email at the registered address. This message contains the Order Number (to be referenced in all communications), price summary, and shipping address. The Customer must promptly report any discrepancies.
  • Seller’s Acceptance: The contract is deemed concluded only when Morani s.r.l. accepts the order (even partially), which may occur implicitly through shipment of the goods.
  • INCI (Ingredients List) Notice: Ingredient information displayed on the website is purely indicative and may vary. Customers are invited to always refer to the ingredient list printed on the product packaging, which constitutes the official and updated source.

 

AVAILABILITY AND STOCK MANAGEMENT

The website is designed to show real-time availability. However, simultaneous access by multiple users may cause discrepancies between displayed and actual stock.

  • In the event of total or partial unavailability, Morani s.r.l. will promptly contact the Customer by phone or email.
  • The Customer may choose to wait for restocking, replace the product, or cancel the order and receive an immediate refund.

 

PRICES AND PAYMENT METHODS

  • Price List: All prices are expressed in Euros (€) and include VAT. Shipping costs are excluded and shown separately before final order confirmation.
  • Price Changes: Prices may vary due to market fluctuations; however, the price displayed at the time of order submission shall apply. Shipping costs are borne by the Customer and clearly shown before order completion. If price discrepancies arise after order submission, the Customer will be promptly informed and may withdraw from the purchase without penalty.
  • Payment Methods:

• NEXI Platform: Secure encrypted payments via credit/debit cards and digital wallets (Apple Pay, Google Pay), ensuring high fraud-protection standards.

Bank Transfer: Shipment will occur only after funds are credited to the Company’s bank account (usually within 3–5 business days).

 

SHIPPING, DELIVERY, AND CUSTOMS CHARGES

  • Logistics: Shipments are handled by national and international express couriers. Estimated delivery time is 10–20 business days from dispatch, barring force majeure or remote areas.
  • Customer Obligations upon Delivery: The Customer must check that the packaging is intact and that the number of packages matches the delivery note (DDT).
  • Inspection Reservation: In case of anomalies, the Customer must accept the goods with written reservation (“Subject to inspection – damaged/open packaging”) on the courier’s delivery receipt. Without such reservation, claims for cosmetic damage or shortages will not be accepted.
  • Non-EU Orders: Any customs duties, local taxes, or import charges are the sole responsibility of the Customer.

 

RIGHT OF WITHDRAWAL AND RETURN POLICY

Pursuant to Article 52 of the Consumer Code, the Customer (private consumer) may withdraw from the contract within 14 days of receipt of goods.

  • Exclusions: The right of withdrawal does not apply to opened, partially used, or sealed goods that are not suitable for return for hygiene reasons (e.g., opened oil bottles/cans).
  • Exercise of the Right: The Customer must send an explicit request via email to info@frantoiomorani.it. Once authorized, the product must be returned intact at the Customer’s expense.
  • Refund: Morani s.r.l. will refund the amount paid within 14 days of receiving the returned goods, after verifying their condition. Any damage occurring during return shipment will be charged to the Customer. If the return is accepted, the refund will be issued net of shipping costs.

 

COMPLAINTS, WARRANTY, AND SUPPORT (RMA)

Morani s.r.l. guarantees that products comply with national quality standards.

RMA Procedure: Any issue must be reported by requesting an RMA form. Authorized goods must be returned carriage paid.

Technical Checks: If a product returned as defective is found to be fully functional after inspection, a flat fee of €25.00 + VAT will be charged for technical and handling costs, plus reshipping expenses.

 

APPLICABLE LAW AND DISPUTE RESOLUTION

This contract is governed by Italian law.
For any dispute arising from interpretation or execution of this contract, the exclusive jurisdiction shall be the Court of Brescia (BS).

Pursuant to EU Regulation No. 524/2013, Customers are informed of the possibility to resolve disputes via the Online Dispute Resolution (ODR) platform available at:
